Reqsy Recruiter Agreement
This Recruiter Agreement (the "Agreement") governs the relationship between Reqsy, LLC and the Recruiter as an independent recruiter on the Reqsy platform.
1. Marketplace Status
Reqsy is a marketplace facilitator only and does not directly recruit, employ, or place candidates.
2. Independent Contractor Status
Recruiters are independent contractors solely responsible for:
- Candidate sourcing
- Screening
- Compliance
- Taxes
- Expenses
3. Candidate Ownership
Any candidate submitted through the Reqsy platform is owned by Reqsy for a period of 12 months from the date of submission. If a client hires that candidate through any channel within 12 months of submission, the full agreed placement fee is owed to Reqsy regardless of how the hire was made. All submissions are timestamped and logged as legal proof of submission date.
4. Client Ownership & Non-Circumvention
Reqsy retains ownership of platform-introduced clients for one year. Recruiters may not:
- Contact clients outside platform
- Solicit side business
- Circumvent Reqsy
If a recruiter is found to have circumvented the platform they will owe Reqsy the full placement fee plus a penalty of $5,000. Reqsy reserves the right to pursue additional legal action.
5. Platform Fees
Reqsy keeps a flat 20% of every placement fee. The recruiter keeps 80%.
6. Payment Terms
Recruiter payment is contingent upon:
- Successful placement
- Client payment
- Compliance with platform rules
Reqsy will process recruiter payment within 5 business days of receiving cleared client payment. Recruiters will receive email confirmation when payment has been processed.
7. Competitive Marketplace
Reqsy operates on a race-to-submit model unless otherwise specified.
8. Restricted Conduct
Prohibited:
- Fake submissions
- Duplicate candidates
- Misrepresentation
- Spam
- Confidentiality breaches
9. Enforcement
Violations may result in:
- Termination
- Fee forfeiture
- Legal action
Recruiters have 30 days to dispute any enforcement action by contacting grace@goreqsy.com. Reqsy will review and respond within 10 business days.
10. Subscription Fees
Recruiters agree to pay the applicable monthly subscription fee — Basic Plan at $50 per month or Premium Plan at $100 per month — after the 60-day free trial period ends. Subscription fees are billed automatically through Stripe. Failure to maintain an active subscription will result in account suspension until payment is resolved.
11. Confidentiality
Recruiters agree to keep all client information, candidate information, job details, and platform data strictly confidential. Recruiters may not share, sell, or distribute any platform information outside of Reqsy for any reason.
12. Limitation of Liability
Reqsy is a marketplace facilitator only. Reqsy's total liability to any recruiter shall not exceed the total fees paid to that recruiter in the 3 months preceding any claim. Reqsy is not liable for client non-payment, candidate withdrawal, or any outcome of the hiring process.
13. Agreement Updates
Reqsy reserves the right to update this agreement at any time with 30 days written notice sent to the recruiter's registered email address. Continued use of the platform after 30 days constitutes acceptance of the updated agreement.
14. Governing Law
Governed by Florida law.
